ADA is a civil rights law designed to provide equal access to employment, goods, and services to people with disabilities. The regulations are divided into five titles:

  • Title I – Employment including application process, hiring, wages, benefits, and all other aspects of employment.
  • Title II – Public Services governs services provided by local and state governments, (does not include federal government), public commuter services, participation in all services provided.
  • Title III – Public Accommodations applies to access to all goods and services available to the general public provided by private business and sate and local governments. Does not apply to religious organization in most cases. All new construction and remodeled buildings must provide equal access to disabled individuals on an equal basis with able bodied individuals. Existing building must remove barriers to equal access if readily achievable. This includes privately owned transportation services, restaurants, hotels, entertainment venues, retail businesses, service providers such as healthcare facilities and any other provider of goods and services available to the public.
  • Title IV – Telecommunications businesses. Mainly applies to accommodations for hearing impaired individuals.
  • Title V – Miscellaneous. Applies to all other issues relating to providing equal access to individuals, their families, caregivers, and service providers for individuals with disabilities.

The ADA protections primarily apply to individuals who fit the ADA’s definitions of persons with disabilities. These include:

  • Persons with physical or mental impairments that substantially inhibit one or more major life activity
  • A person with a record of such impairment
  • A person who is regarded as having such and impairment

ADA regulations provide only equal treatment for people with disabilities.
